Providing an Aggressive Defense to Criminal Charges
Trafficking in a drug involves “possessing with intent to distribute.” Laws in Massachusetts impose very severe penalties for drug trafficking crimes and carry the following mandatory minimum jail sentences depending on the amount of the drug:
Trafficking in heroin:
- Three and a half years for 18 grams to 36 grams
- Five years for 36 grams to 100 grams
- Eight years for 100 grams to 200 grams
- Twelve years for more than 200 grams
Trafficking in other types of opioids and in synthetic opiates:
- Two years for 18 grams to 36 grams
- Three and a half years for 36 grams to 100 grams
- Eight years for 100 grams to 200 grams
- Twelve years for more than 200 grams
Additionally, any assets allegedly used during the drug crime — such as a car or cash — may be seized by the government through a forfeiture process.
